Protect App-Based Drivers + Services Joined by Social Justice Advocates, Business Organizations and Advocacy Groups in Opposing AB 1340

Misguided Bill Threatens Rideshare Jobs and Services and Risks the Privacy of Millions of App-Based Drivers

Assembly Bill 1340 (Wicks, Berman) will have drastic consequences for millions of Californians if enacted, which is why business and social advocacy groups from across the state have joined together with Protect App-Based Drivers + Services, representing nearly 130,000 app-based drivers, in opposing the bill. AB 1340 jeopardizes the rights of app-based drivers to work as independent contractors, threatens drivers’ personal information, and creates an undemocratic process that allows a small minority to dictate the will of all California rideshare drivers.

“Enough is enough,” said Al Porche, a San Diego Rideshare driver. “Voters approved Prop 22, and the courts upheld the law, yet special interest groups are repeatedly trying to undermine our rights as drivers. This bill is bad for drivers, bad for consumers and will threaten the personal information and privacy of millions of rideshare drivers like me. The legislature should reject this policy.”

The bill, which passed out of the Senate Labor, Public Employment and Retirement Committee today, would require app-based rideshare platforms to disclose sensitive personal information—including names, driver’s license numbers, home addresses, cell phone numbers, and work histories—to outside third-parties and the state. This could put drivers’ personal data at risk and expose them to unwanted calls, texts, emails, and even home visits by solicitors.

“At the National Action Network, we are committed to justice, decency and equal opportunities, all of which are threatened by AB 1340,” said Dr. Tecoy Porter, President, National Action Network (NAN) Sacramento Chapter. “This bill jeopardizes private data, puts jobs at risk and undermines the will of voters. AB 1340 would disproportionately hurt people of color and disadvantage communities that rely on independent app-based work to make ends meet.”

If enacted, AB 1340 would give a union access to the personal information of every app-based driver in California—even if most drivers never agreed to it. With signatures from just 30% of drivers, a union could claim to represent 100% of them without a vote and begin collecting hundreds of dollars in dues from everyone. That’s not choice—it’s forced representation and it’s unfair to the vast majority of drivers who want to keep their independence.

AB 1340 could also impact consumers and threaten the availability and affordability of rideshare by forcing companies to fundamentally change the way they operate. The bill could drastically alter customer convenience, leading to increased prices and reduced rideshare service availability, especially for disadvantaged and under-resourced communities.

The bill would threaten the independence that app-based drivers overwhelmingly prefer.

Surveys consistently show that the vast majority of drivers choose app-based work because of the flexibility it provides, as most drive on a part-time, supplemental basis. Survey data highlights the strong, ongoing support for drivers to remain independent contractors:

  • 71% of drivers prefer being independent contractors
  • 84% of drivers say that flexibility is important to them
  • 79% of drivers say that the ability to make extra money is important

Finally, AB 1340 also puts at risk the earnings of over 1.6 million Californians who work with app-based rideshare platforms. A recent study found that drivers earned an average of $37 per hour (including tips and bonuses) under Proposition 22.
