1,000 App-Based Drivers Urge Lawmakers to Oppose AB 1340

Bill Violates the Privacy of Millions of App-Based Drivers and Threatens Rideshare Jobs and Services

A powerful message from 1,000 app-based drivers across California was sent to legislators ahead of the Senate Committee on Transportation hearing, expected early next month: protect their independence. These drivers are united in their urgent call for lawmakers to reject Assembly Bill 1340 (Wicks, Berman), a bill that threatens their privacy, their jobs, and the very independence they voted for.

“Enough is enough,” said San Diego rideshare driver Al Porche. “Voters approved Prop 22 and the courts upheld the law, yet special interest groups are repeatedly trying to undermine our rights as drivers. This bill is bad for drivers, bad for consumers and will threaten the personal information and privacy of millions of rideshare drivers like me. The legislature should reject this policy.”

AB 1340 is bad policy for millions of rideshare drivers because it:

 

  • Forces companies share the personal information of rideshare driversincluding names, driver’s licenses, home addresses, phone numbers – with outside third-parties, potentially subjecting them to unwanted calls, texts and even home visits. This is a dangerous violation of driver privacy.
  • Allows a small minority to make decisions for all. Under AB 1340, a union only needs signatures from 10% of “active” California drivers to access the private information of all drivers in the state. If a union gets signatures from 30% of California drivers, they automatically represent 100% of drivers – no vote, no say, and unions can begin collecting hundreds of dollars in dues. This is undemocratic.
  • Undermines the independence drivers overwhelmingly prefer and need. Surveys consistently confirm that the vast majority of drivers choose app-based work because of the flexibility it provides, as most drive on a part-time, supplemental basis. AB 1340 threatens the independence drivers rely on.
  • Puts hundreds of thousands of Californians’ earnings at risk. Drivers are earning an average of $37 per hour (including tips and bonuses) under Prop 22. By attacking independent app-based models, AB 1340 jeopardizes the income of hundreds of thousands of Californians at the worst possible time.
  • Harms consumers, by making rideshare more expensive and less reliable. AB 1340 could lead to higher prices and fewer rides, especially for disadvantaged and under-resourced communities.
