AB 1340 Violates Privacy of Millions of App-Based Drivers and Threatens Rideshare Jobs and Services

Protect App-Based Services (PADS) Coalition – Representing Nearly 130,000 California App-Based Drivers – Calls on State Legislature to Reject the Bill

Assembly Bill 1340 (Wicks), which passed out of the California State Assembly today, undermines Prop 22 by threatening app-based jobs and services, and endangering rideshare driver privacy. The bill dangerously threatens drivers’ personal information and privacy, allows a small minority of drivers to dictate decisions for all, and threatens the independence that app-based drivers overwhelmingly prefer and need.

AB 1340 also jeopardizes the availability and affordability of rideshare services by creating an untenable framework for independent contractor drivers. The bill will harm Californians seeking to earn a living and riders in need of transportation access.

If approved, AB 1340 would require app-based rideshare platforms to disclose sensitive personal information—including names, driver’s license, home addresses, cell phone numbers, and work histories—to third-parties and a state agency. This could put drivers’ personal data at risk, and expose drivers to unwanted calls, texts, emails and even home visits by third-parties.

Additionally, under AB 1340, a union could access all drivers’ private information by securing signatures from just 10% of active app-based rideshare drivers in California. If a union gathers signatures from just 30%, it would be automatically appointed to represent all rideshare drivers, enabling the collection of dues without requiring a vote.

“AB 1340 is not only undemocratic and costly – it blatantly disregards the voices of drivers like me and the millions of Californians who supported our right to remain independent contractors,” said Stephanie Whitfield, a Palm Springs-based rideshare driver. “This bill threatens my ability to choose how I work and allows a small minority to dictate terms for all California rideshare drivers. It’s bad for drivers and bad for consumers. I urge lawmakers to vote no on this dangerous proposal.”

A survey from 2023 highlights the strong, ongoing support for drivers to remain independent contractors:

  • 71% of drivers prefer being independent contractors
  • 84% of drivers say that flexibility is important to them
  • 79% of drivers say that the ability to make extra money is important

“AB 1340 is a violation of my privacy, paycheck and independence,” said Al Porche, a San Diego-based rideshare driver. “This bill would require that my private and personal information be shared with groups and agencies without my consent, which is very concerning. I urge our state senators to stop this bill in its tracks, before millions of Californians’ personal information is shared so broadly.”

AB 1340 also puts at risk the earnings of over 1.6 million Californians who work with app-based rideshare platforms. A recent study found that drivers earned an average of $37 per hour (including tips and bonuses) under Prop 22.
