Protect App-Based Drivers & Services Act Would Impose Significant New Safety Protections and Protection Against Sexual Assault & Harassment

The Protect App-Based Drivers & Services Act would implement new safety measures to protect app-based drivers, customers and the general public. The measure:

  • Provides for continuous background checks of drivers.
  • Prohibits drivers from utilizing a rideshare service if they’ve been convicted of any violent felony, serious felony or any hate crime.
  • Provides for immediate suspension of an app-based driver if arrested for any violent felony, serious felony or any hate crime, as well as for certain lesser offenses. The suspension shall only be lifted upon disposition that does not result in conviction.
  • Prohibits drivers from utilizing a rideshare service if they’ve been convicted within the last seven years of the following crimes:
    • Misdemeanor assault or battery
    • Domestic violence offense
    • Driving under the influence of alcohol or drugs
  • Requires network companies to establish a 24/7 method for law enforcement to submit requests for information to aide in investigations related to emergency situations, exigent circumstances and critical incidents.
  • Requires companies to have established sexual harassment policies intended to protect app-based drivers, customers and members of the public. Drivers must review and affirm they will comply with the policy. The policy shall identify behaviors that may constitute sexual harassment, including:
    • Physical touching or assault
    • Impeding or blocking movements
    • Unwanted sexual advances
    • Gestures or displaying sexually suggestive objects, pictures, cartoons, or posters
    • Derogatory comments, epithets, slurs, or jokes
    • Graphic comments, sexually degrading words, or suggestive or obscene messages or invitations
